Please read this Agreement carefully and completely before using our websites, including goldenagemedicare.com (the “Applications”) or any services or goods provided through or in connection with the Applications or by Golden Age Medicare or one of its subsidiaries or affiliates (together with the Applications, collectively, the “Service”). By clicking “I Accept” to this Agreement, or by using the Service (including any access to the Service), you expressly agree to be bound by this Agreement, by and between you and Golden Age Medicare (also referred to as “Golden Age Medicare”, “us” or “we”), which incorporates by this reference any additional terms and conditions posted by Golden Age Medicare through the Applications, or otherwise made available to you by Golden Age Medicare.

THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION OF DISPUTES PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.

Updates to this Agreement

We may update this Agreement at any time by notifying you of such updates by any reasonable means, including posting the revised Agreement on the Applications. Any modifications will be effective immediately upon posting.

Products and Transactions

References to or descriptions of products or services (including health plans) on the Service should not be interpreted as endorsements. Prices, eligibility, and availability are subject to change without notice.

Materials

“Materials” includes user IDs, email addresses, passwords, comments, photographs, images, graphics, text, and other data submitted by you through the Service.

Golden Age Medicare and its suppliers are not required to monitor or police Materials for compliance with laws or this Agreement. You may find some Materials posted by other users offensive, harmful, or inaccurate—use caution when using the Service.

NO WARRANTIES

Golden Age Medicare provides the Applications “AS IS” and disclaims all express or implied warranties (including merchantability, fitness for a particular purpose, or non-infringement). Some jurisdictions do not allow the exclusion of implied warranties, so this may not apply to you.

LIMITATION OF LIABILITY

In no event will Golden Age Medicare, its affiliates, or partners be liable for any direct, indirect, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages.

Your Obligations

  • You must be of legal age to use the Service (18+ to register).

  • You agree to provide accurate and current information.

  • You will not misuse the Service (e.g., hacking, spamming, distributing malware).

  • You are responsible for maintaining the confidentiality of your login credentials.

Ownership of the Applications

The Applications and their content are the property of Golden Age Medicare (or its licensors) and protected by intellectual property laws. You may not:

  • Modify, reverse-engineer, or redistribute the Applications.

  • Use the Applications for commercial purposes without permission.

  • Remove or obscure copyright or proprietary notices.

Third-Party Resources

The Applications may contain links to third-party sites, Medicare plans, or services (“Third-Party Resources”). Golden Age Medicare does not control or endorse these resources and is not responsible for their content, privacy policies, or security.

Trademarks

The Golden Age Medicare name and all related trademarks are the property of Golden Age Medicare or their respective owners. Unauthorized use may violate trademark laws.

Plan Enrollment Applications

If you enroll in a third-party plan through our Service:

  • Your electronic signature is legally binding.

  • You are responsible for keeping your contact information updated.

  • Hardware/software requirements for enrollment include an up-to-date browser and PDF reader.

Not a Substitute for Professional Health Care Advice

The health information provided is general and not a substitute for professional medical advice. Consult a healthcare provider for specific needs.

Privacy

Our Privacy Policy governs your use of the Applications and is incorporated into this Agreement.

Termination

Golden Age Medicare may suspend or terminate your access if you violate this Agreement.

Dispute Resolution

All disputes must be resolved through individual arbitration (not class actions). Before arbitration, you must first submit a written Demand for Arbitration to:

Governing Law

This Agreement is governed by U.S. federal law and Illinois state law, excluding conflict of laws principles.

Indemnity

You agree to indemnify Golden Age Medicare against any claims arising from your misuse of the Service.

Entire Agreement

This Agreement constitutes the entire agreement between you and Golden Age Medicare, superseding all prior agreements.
